                 FINALLY, LET US EXPLAIN OUR CONVEYANCING SERVICES

If you are thinking of buying a property in Spain -or indeed elsewere- you should take into consideration that the signing of deeds, the registration of such deeds and the payment of taxes does not guarantee that your purchase is trouble-free. This applies to Spain and the rest of the world, because:

*   The property you have bought might have been built illegaly or lacking the necessary licenses for habitation, or indeed the construction might not be up to standards.

*   The property you are buying needs to be properly identified, (someone could show you a beautiful property and if not identified with the deeds and planning information, you could end up by buying a little studio next door instead of the grand villa you paid for).

*   Maybe you are told that the property you are purchasing is debt free and, maybe later you find out that the property is heavily mortgaged, or even worse, listed for embargo.

*   The ownership of the property has to be fully verified, otherwise you could end up buying a fraction belonging to -say- a divorcing spouse, only to find later on that the other spouse has not sold you nothing. Or indeed, someone claiming to own a lovely property could lure you into buying something belonging to someone else. Or worse still, a seller using false documentation.. etc.. etc.. It is obvious that people -when in need of money, are known to use incredibly creative ideas.

*   The concept of freehold can be, at times, grossly misleading and it is not unusual to find that you buy a property and later you find that the expenses of maintenance, community fees, and communal running costs are really prohibitive. 

*   Indeed, inscribing the purchase at the Property Registry, preparing the deeds and checking payment of taxes are important parts of conveyancing, but as you might have gathered by reading the above these requirements are far from sufficient.

Allow us to give you a list of what you should

 GENERAL ADVISE; NEVER DO:

1st)   Do not ever sign anything without obtaining a copy of what you have signed.

2nd)   Never give anyone any money -even a small deposit- without obtaining a receipt together with a detailed list of services agreed.

3rd)   Never sign anything or give any money, or indeed accept any sort of compromise without consulting with your Spanish Lawyer.

4th)   Never belive anyone saying to you that -in Spain- when you enter into contract you do not need a Lawyer, be sure that such a person intends (to put it mildly) taking advantage of his position.

By now you must be thinking: "but I never would do such things...". We are sure you wouldn´t, however, every year thousands do in a regular basis; sometimes because the "idillic" and relaxed Spanish way of life leads normally intelligent people to do things they would NEVER DREAM of doing at home or, because the fraudulent and ignorant vocation of some -so called- "advisors" very often end up convincing perfectly intelligent people into acting against their very own interests. In any case, do not forget the above four words of advise; Spain is a wonderful country to come to and to invest and the Spanish way of life -among holiday and second residence destinations- is second to none; keep away from adventurous behaviour and from improvisation and NEVER DO ANYTHING YOU WOULD NOT DO AT HOME.
